TERMS OF SALES

The present conditions of sale are concluded on the one hand by the company SARL Arbo2 with a capital of 8000 €. The head office is located in Forêt de Brise Charrette BP 10,  51 380 Verzy, France, and the company is registered with the Trade and Companies Register of Reims under the number 489512038, hereafter referred to as "SARL Arbo2", manager of the site perchinglife.com (https://perchinglife.com/) and, on the other hand, by any natural or legal person wishing to make a purchase via the perchingbar website, perchinglife.com (https://perchinglife.com/) hereafter referred to as "the buyer."

Article 1: object

The present conditions of sale aim at defining the contractual relations between SARL Arbo2 and the buyer; these conditions being applicable to any purchase made through the perchingbar website, perchinglife.com (https://perchinglife.com/). The acquisition of a product through this site implies acceptance without reservation by the buyer of these conditions of sale which the buyer acknowledges having read prior to his order. Before any transaction, the buyer declares on the one hand that the purchase of products on the site perchinglife.com (https://perchinglife.com/) is not directly related to his professional activity and is limited to a strictly personal use and secondly has full legal capacity, allowing her or him to enter into an agreement under these terms and conditions of sale.

The company Arbo2 retains the right to modify at any time these conditions of sale, in order to respect any new regulation or to improve the use of its site. These conditions continue in effect from the date of purchase by the buyer.

Article 2. Products

The products offered are those listed on the site perchinglife.com (https://perchinglife.com/) of the company Arbo2, within the limits of available stock. The company Arbo2 reserves the right to modify the product assortment at any time. Each product is presented on the website as a description of its main technical characteristics (capacity, use, composition ...). The photographs are as faithful as possible, but do not bind the seller. The sale of the products presented on the site perchinglife.com (https://perchinglife.com/)is intended for all buyers resident in countries that fully authorize the entry into their territory of these products.

Article 3. Fees

The prices listed on the product sheets of the Internet catalog are designated in Euros (€) and include all taxes (VAT), applying the VAT rate on the day of purchase. Any change in the VAT rate may be reflected in the price of the products. The company Arbo2 reserves the right to modify its prices at any time, it being understood however that the price appearing in the catalog the day of the order will be the only one applicable to the buyer.

Article 4. Order and payment methods

Before ordering, the buyer must create an account on the site perchinglife.com (https://perchinglife.com/). The account section is accessible from the sidebar. During each visit, the buyer, if she or he wishes to order or consult his account (order status, profile ...), must identify himself or herself using the identification information she or he provided. The company Arbo2 offers the buyer the possibility of ordering and paying for its products in several stages, with only one payment option.

Secure payment by credit card: the buyer selects the products he or she wishes to order in the "basket," modifies the selection(s) if necessary (quantities, references ...), checks the delivery address or provides a new one. The shipping costs are automatically calculated and submitted to the buyer, along with the name of the carrier. Then the buyer selects the method of payment: "Payment by credit card." The next step is to check all the information, read and accept the terms and conditions by checking the corresponding box. Then the buyer may validate the order by clicking on the button "Confirm my order." Finally, the buyer is redirected to the secure credit card interface to securely provide his or her personal credit card account information. If payment is accepted, the order will be automatically registered and the contract definitively formed. Payment
by credit card is irrevocable. However in case of fraudulent credit card use, the buyer will have the right to demand the cancellation of the credit card payment, the sum paid will be then credited or returned.
THE CREDIT CARD HOLDER WILL NOT BE HELD RESPONSIBLE IF THE DISPUTED PAYMENT HAS BEEN SHOWN TO HAVE BEEN CARRIED OUT REMOTELY (without physical use of his or her card) and FRAUDULENTLY.

In order to obtain a refund of the fraudulent debit and any bank charges that the transaction may have incurred, the cardholder must challenge, in writing, the withdrawal from his bank, within 70 days of the transaction, or 120 days if the contract so states. The amount withdrawn will be reimbursed by the bank within a maximum of one month after receipt of the written dispute from the card holder. No restitution expenses will be charged to the card holder.

The confirmation of an order implies acceptance of these conditions of sale, the acknowledgment of having perfect knowledge and the waiver of its own terms of purchase . All data provided and the recorded confirmation will serve as proof of the transaction. If the buyer has an email address and if he or she has indicated it on the order form, the company Arbo2 will confirm the transaction via email.

Article 6. Retraction

Under Article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the delivery of his or her order of physical products to exercise his or her right to withdraw and return the product to the seller for an exchange or refund without penalty, except for the costs of return.

Article 7. Cancellation of reservations

CASE N°1: Cancellation by the client

• 7 days or more before the reservation date: full refund of the amount paid.

• Between 48 hours and 7 days before the date: 50% refund of the amount paid.

• Less than 48 hours before the date: no refund will be granted.

CASE N ° 2: Cancellation by the Perchingbar management

Up to 30 days before the reservation date, the management reserves the right to cancel the reservation without penalty **.
The full refund will be credited to the your credit card.

** Because the Perchingbar is an establishment perched in the trees, there are constraints related to the environment, some of which are unforeseeable. In order to meet the safety requirements, maintenance interventions may result in the temporary closure of the site on one or more days.
Beyond a 30-day period, your refund will be applied and followed by a free offer for a subsequent visit for each person who has booked.

CASE N ° 3: Cancellation for violent weather, thunderstorms, strong wind, Orange alert ...

In case of bad weather conditions, the management may decide to cancel your booking without warning and for obvious security reasons close the Perchingbar. A full refund (online payment fees included) or a postponement of your reservation will be offered.

Article 8. Delivery

Deliveries are made to the address indicated on the order form and can only be shipped to the agreed upon geographical area. Orders are made by La Poste via COLISSIMO, delivery service with tracking, delivery without signature. Delivery times are only approxmiate; if they exceed thirty days from the order, the contract of sale may be terminated and the buyer refunded. The company Arbo2 will be able to provide by email to the buyer the tracking number of his or her parcel. The product will be delivered to the buyer’s home by the postman. If the buyer is absent, he or she will receive a notification of attempted delivery from the postman, which allows the buyer to collect the order at the nearest post office, for a period indicated by the postal services. Transportation risks are the responsibility of the purchaser from the moment the articles leave the premises of the company Arbo2. The buyer is obliged to sign upon delivery of the order in the presence of the postal employee or the delivery person and to report the condition of the packaging of the goods and its contents upon delivery. In case of damage during transport, any complaint must be made to the carrier within three days of delivery.

Article 9. Warranty

All products supplied by the company Arbo2 benefit from the legal guarantee provided by articles 1641, following of the Civil Code. In case of nonconformity of a product sold, the product can be returned to the company Arbo2 which will take it back, providing an exchange or refund. All claims, requests for exchange or refund must be made by post to the following address: Arbo2, Forêt de Brise Charrette BP 10,  51 380 Verzy, France, within thirty days after delivery.

Article 10. Liability

The company Arbo2, in the process of distance selling, only has resellers obligations . It cannot be held responsible for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, interruption of service, or other involuntary problems.

Article 11. Intellectual Property

All the elements of the site perchinglife.com (https://perchinglife.com/) are and remain the intellectual and exclusive property of the company Arbo2 . No one is permitted to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether in the form of photo, logo, visual depiction or text.

Article 12. Personal data

The company Arbo2 undertakes to preserve the confidentiality of the information provided by the buyer, which he or she transmits for the use of Arbo2’s services. All information concerning the buyer is subject to the provisions of Law No. 78-17 of 6 January 1978. As such, the user has a right to access, modify and delete information about himself or herself. Article 13. Dispute Resolution

These conditions of distance selling are subject to French law. For all disputes or litigation, the competent court will be that of Reims
